Tilt 350 Terms & Conditions

1. Introduction
Welcome to Tilt 350, a creative marketing and design agency that operates on a collaborative model with a network of creative partners. By engaging our services, you agree to the following Terms and Conditions. These terms outline the nature of our services, payment terms, usage of complimentary services, intellectual property rights, and other conditions relevant to our client relationships.


2. Scope of Services
Tilt 350 provides creative marketing, brand strategy, design, and digital solutions. Our services are delivered by a team of skilled professionals from the USA, Canada, and Pakistan, all working under the Tilt 350 brand to create customized solutions for each client. The exact nature and scope of services are outlined in each client agreement.


3. Complimentary Services and Limited Access
Tilt 350 may, at its discretion, provide complimentary services such as initial consultations, mock designs, or sample work (e.g., a mock website layout) to give potential clients insight into our approach and capabilities.
Limitations on Complimentary Services: Complimentary services, such as mock websites or trial designs, will have a validity of 48–72 hours from the time they are delivered. Access to these samples will expire after this period unless the client formally engages Tilt 350 for ongoing work.
No Guarantee of Additional Revisions: Complimentary services are intended as a demonstration only. Tilt 350 is under no obligation to perform revisions or further adjustments beyond the initial sample unless a paid engagement is established.
Protection Against Misuse: These complimentary offerings are not intended to be fully functional final products. Clients agree that any mock or trial work provided by Tilt 350 remains the intellectual property of Tilt 350 until a formal agreement and payment are completed.


4. Intellectual Property Rights
Ownership: All creative concepts, designs, mock-ups, and any other work produced by Tilt 350 remain the intellectual property of Tilt 350 until full payment is received. Upon payment, ownership of the final deliverables transfers to the client, but Tilt 350 reserves the right to showcase non-confidential project work in its portfolio or marketing materials.
Usage Rights: Clients are granted limited usage rights for complimentary samples and mock-ups. Unauthorized reproduction or distribution of Tilt 350’s creative work without payment and written consent is strictly prohibited.


5. Engagement Terms and Payment
Project Fees: Tilt 350 charges a project fee or hourly rate as specified in the client’s proposal or statement of work. Fees are based on the scope of work and project complexity.
Payment Schedule: For larger projects, Tilt 350 may request a deposit upfront, with further payments due upon project milestones or upon final delivery. Payment terms will be outlined in the client contract and are generally due within 14 days of invoice.
Late Payments: A late fee of 2% of the outstanding balance per month will be applied to invoices that are more than 14 days overdue. Clients are responsible for ensuring timely payment to avoid penalties and potential disruption of service.
Non-Payment and Suspension of Services: In the event of non-payment, Tilt 350 reserves the right to suspend all services until the outstanding balance is paid in full. Persistent non-payment may result in termination of the project, and Tilt 350 may pursue legal action or collections if necessary.


6. Project Cancellation and Refund Policy
Client-Initiated Cancellations: If a client cancels the project after work has commenced, Tilt 350 reserves the right to retain the deposit or payment for work completed to date. Any additional work performed beyond the deposit amount will be billed and payable upon cancellation.
Agency-Initiated Cancellations: Tilt 350 may cancel the project due to non-payment, breach of terms, or other justifiable circumstances. In such cases, Tilt 350 will provide notice to the client and cease all work.


7. Creative Process and Revisions
Creative Control: While Tilt 350 welcomes client input and feedback, the agency retains creative control over the project’s execution based on the agreed-upon scope. Excessive or out-of-scope revisions will incur additional charges as specified in the client contract.
Revision Policy: Each project includes a limited number of revisions as specified in the contract. Additional revisions beyond the agreed number will be billed separately at our standard hourly rate or per-revision rate.


8. Use of External Creative Partners
Collaborative Model: Tilt 350 works with a network of creative partners across different regions, allowing us to bring unique perspectives to each project. By engaging Tilt 350, clients acknowledge and consent to the involvement of these vetted partners as part of the service model.
Consistency and Quality: While Tilt 350 ensures the quality and consistency of work across its partners, the agency retains the right to manage partner relationships and deliverables on behalf of the client.


9. Limitation of Liability
Tilt 350 makes no guarantees as to the results or outcomes of its creative work, as results may vary based on numerous factors beyond our control. Clients acknowledge that any recommendations, designs, or strategies are implemented at their discretion, and Tilt 350 is not liable for unintended outcomes.
Tilt 350’s liability is limited to the fees paid by the client for the specific project and does not extend to indirect, incidental, or consequential damages.


10. Changes to Terms
Tilt 350 reserves the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes, and the most current version of these terms will be posted on our website.
